These Terms of Service (“Terms”) govern your access to and use of ThetaTracker Pro (the “Service”), operated from Las Vegas, Nevada, United States. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
ThetaTracker Pro is an options-trading journal and analytics tool for self-directed traders. It connects to your brokerage account on a read-only basis to import your positions, balances, and transaction history, and organizes that information into a journal with metrics, roll tracking, and summaries. The Service is an informational and record-keeping tool only.
Not financial, investment, tax, or legal advice. ThetaTracker Pro does not provide investment advice, recommendations, or solicitations to buy or sell any security. Nothing in the Service constitutes financial, tax, or legal advice. All trading and investment decisions are your own. Options trading involves substantial risk and is not suitable for every investor. You are solely responsible for your trading decisions and their outcomes.
ThetaTracker Pro does not hold, custody, or have access to your funds or securities. We connect to your brokerage account through a third-party aggregation provider (SnapTrade) using access you explicitly authorize. In its current form, the Service accesses your account on a read-only basis and cannot place trades or move money.
If, in the future, the Service offers order-placement features, any trades will be initiated and directed solely by you; ThetaTracker Pro will not exercise discretion over your account, and you will remain fully responsible for reviewing and confirming any order before it is submitted. Your use of any connected brokerage remains subject to that brokerage’s own terms and agreements.
Data displayed in the Service is sourced from your brokerage via third-party connections and may be delayed, incomplete, or contain errors. The Service’s metrics, calculations, and summaries (including any profit/loss, tax-related, or performance figures) are provided for convenience and may not be accurate. You should always verify information against your official brokerage statements and consult a qualified professional for tax or financial matters. Do not rely on the Service as your sole source of record.
Certain features require a paid subscription. Payments are processed by Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis (monthly or annually, as selected) until you cancel. Subscription fees are billed in advance and, except where required by law, are non-refundable for partial periods. You may cancel at any time; cancellation takes effect at the end of your current billing period, and you retain access until then. We may change pricing with reasonable advance notice; changes will not affect the period you have already paid for.
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service, other users’ data, or our systems; interfere with or disrupt the Service; reverse engineer, copy, or resell the Service except as permitted by law; or use the Service to access accounts you are not authorized to access.
The Service, including its software, design, text, and other content (excluding your own data), is owned by ThetaTracker Pro and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose while your account is active. You retain ownership of your own trading data; you grant us the limited rights needed to store and process it to provide the Service.
The Service relies on third parties including SnapTrade (brokerage connectivity), Stripe (payments), and our hosting and data providers. We are not responsible for the acts, omissions, availability, or content of third-party services, and your use of them may be subject to their own terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THETATRACKER PRO AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, TRADING LOSSES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. YOU ACKNOWLEDGE THAT TRADING AND INVESTMENT DECISIONS ARE YOUR OWN AND THAT WE ARE NOT LIABLE FOR ANY TRADING LOSSES.
You agree to indemnify and hold harmless ThetaTracker Pro and its operator from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Nevada, unless otherwise required by applicable law.
